Data We Collect: When you submit a project brief via our contact form, we collect your full name, email address, phone number, company name, service interest, budget range, and project specifications. We also collect standard server logs (IP address, browser type, access timestamps) for security purposes.
Purpose of Processing: Your personal data is processed exclusively for: (a) responding to your project inquiry and providing technical proposals; (b) delivering contracted services; (c) fulfilling statutory tax and accounting obligations; and (d) ensuring platform security through server log monitoring.
Data Retention: Contact inquiry data is retained for 24 months from the date of submission. Contracted client data is retained for the duration of the service agreement plus 5 years in compliance with French commercial law (Code de Commerce, Article L123-22). Server logs are purged after 12 months.
Data Sharing: We do not sell, rent, or distribute personal information to unauthorized third parties. Data may be shared with: (a) cloud hosting providers operating within the European Economic Area; (b) payment processors strictly for transaction fulfillment; and (c) tax authorities upon lawful request.
Your Rights: Under GDPR, you have the right to access, rectify, erase, restrict processing, data portability, and object to processing of your personal data. To exercise these rights, contact us at [email protected]. You also have the right to lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés).
International Transfers: We do not transfer personal data outside the European Economic Area unless adequate safeguards (Standard Contractual Clauses or adequacy decisions) are in place.
Terms of Service
These Terms of Service govern all digital services, software deliverables, and engineering advisory packages provided by DesignStackix, registered at 1 Place de l'Église, 49520 Ombrée d'Anjou, France.
Scope of Work: All services are delivered under explicitly contracted Statements of Work (SOW) executed between the Client and DesignStackix. Each SOW defines the specific deliverables, timelines, milestones, and payment terms applicable to the engagement.
Intellectual Property: Upon complete settlement of all agreed commercial invoices, DesignStackix assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, source code, and digital assets directly to the Client. Pre-existing frameworks, libraries, and tools used in development remain the property of their respective owners.
Payment Terms: Invoices are due within 14 calendar days of issuance unless otherwise specified in the SOW. Late payments incur a statutory interest rate of three times the French legal interest rate (taux d'intérêt légal) as per Article 1231-5 of the French Civil Code. DesignStackix reserves the right to suspend work on outstanding invoices exceeding 21 days.
Project Timelines: Delivery timelines stated in proposals and SOWs are estimates based on current capacity. DesignStackix will notify the Client promptly of any anticipated delays. The Client agrees to provide timely feedback, assets, and access credentials necessary for project progression.
Limitation of Liability: DesignStackix's total aggregate liability for any claim arising from or related to the services shall not exceed the total fees paid by the Client under the applicable SOW. DesignStackix shall not be liable for indirect, consequential, or incidental damages.
Confidentiality: Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 3 years.
Governing Law: These terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Angers, France.
Refund Policy
DesignStackix, registered at 1 Place de l'Église, 49520 Ombrée d'Anjou, France, is committed to fair and transparent commercial practices. This Refund Policy outlines the conditions under which refunds may be issued for services rendered.
Pre-Project Cancellation: If you cancel a project engagement before any work has commenced (within 48 hours of SOW execution), you are entitled to a full refund of any advance payment within 14 business days. Cancellations after work has commenced are subject to the milestone-based refund terms below.
Milestone-Based Refunds: For projects structured around deliverable milestones, refunds are calculated based on completed versus remaining milestones. If DesignStackix fails to deliver a contracted milestone by more than 15 business days beyond the agreed date without valid justification, the Client may request a pro-rata refund for the undelivered portion.
Retainer Services: Monthly retainer services (Continuous Iteration & SLA Retainer) may be cancelled with 30 days' written notice. No refund is issued for the current billing period in progress. Pre-paid annual retainers receive a pro-rata refund for unused full months minus a 10% administrative fee.
Non-Refundable Items: The following are non-refundable: (a) domain name registrations and renewals; (b) third-party software licenses procured on the Client's behalf; (c) cloud infrastructure costs already provisioned; and (d) completed discovery/audit phases where a written report has been delivered.
Dispute Resolution: Refund requests must be submitted in writing to [email protected] within 30 days of the disputed invoice or deliverable. DesignStackix will review the request and respond within 5 business days. Unresolved disputes may be submitted to mediation under the rules of the Mediation Board of the Angers Chamber of Commerce (Chambre de Commerce et d'Industrie d'Angers).
Statutory Rights: This refund policy does not affect your statutory rights under French consumer law (Code de la Consommation) or EU consumer protection directives where applicable.
